AYALA ALL ACCESS TERMS & CONDITIONS

  1. INTRODUCTION 

These Terms and Conditions govern your use of Ayala All Access (the “Website”). Accessing the Website, purchasing movie tickets, snack items, or other merchandise, and participating in any promotions related to the Website or Ayala Malls Cinemas are collectively referred to as the “Service”.

By using the Website or the Service, you agree to be bound by these Terms and Conditions. If you do not agree, please do not continue to use the Website or the Service.

Ayala All Access is owned and operated by AyalaLand Malls, Inc. (ALMI). ALMI may update or change these Terms and Conditions at any time, at its sole discretion. Continued use of the Website or the Service after such changes are posted means you accept the updated Terms and Conditions. We encourage you to review this page regularly to stay informed of any updates. 

  1. DISCLAIMER 

    1. ALMI provides Ayala All Access as an alternative way to purchase movie tickets, snack items, or Ayala Malls Cinemas merchandise on an “as is” and “as available” basis. ALMI makes no representations or warranties, express or implied, regarding the Website or any information, content, products, or Services provided through it.

    2. ALMI, its parent company, subsidiaries, affiliates, and their respective shareholders, directors, officers or employees shall not be liable for any loss, cost, or damage arising from or in connection with any use, inability to use or performance of this facility or any of its Services; any unauthorized access to or modification to any of your content or transmissions; or, any other matter relating to this facility, Website, or any of the Services.

    3. ALMI does not warrant that the Website or Service will (a) be uninterrupted; (b) be free from inaccuracies, errors, viruses or other harmful components; (c) meet your requirements; or (d) operate in the configuration or with the hardware or software you use. If you are dissatisfied with the Website, its content, or these Terms and Conditions, your sole remedy is to discontinue using the Services. You acknowledge that your use of the Website and Services is at your own risk.

    4. In the event any applicable law does not permit the above limitation of liability, or any portion of it is deemed invalid or unenforceable, ALMI’s total liability shall not exceed the amount you paid for the relevant transaction made through the Service. 

  1. USE OF THE SERVICES 

    1. Ayala All Access Services are available only to individuals who are legally capable of entering into binding contracts under applicable law. Without limiting the foregoing, our Services are not available to minors (persons under 18 years of age). If you are under 18, you may use the Services only with the involvement and supervision of a parent or legal guardian.

    2. Creating an account is not currently a requirement to access the Website or use the Services. However, when you use the Services, such as purchasing tickets or snack items, certain personal information (full name, mobile number, and email address) may be collected to process your transaction. You remain responsible for the accuracy of the personal information you provide, which will be used and protected in accordance with the Ayala All Access Data Privacy Notice. You acknowledge that no data transmission over the internet can be completely secure, and Ayala All Access cannot guarantee absolute protection of the personal information you share. If you do not wish for your personal data to be used in this manner, please refrain from using the Services.

    3. Employees of ALMI, their relatives, and related corporate entities are not entitled to participate in any promotions, raffles, or competitions related to the goods and services offered on the Website or organized by Ayala Malls Cinemas. This restriction extends to relatives up to the second degree of consanguinity or affinity.  

  1. PERMITTED USE 

    1. The Website and Services are provided for your personal and non-commercial use only. Unless otherwise authorized in writing by ALMI, you agree not to copy, download, publish, modify, distribute, or use any material from the Website or Services for purposes other than:

      1. Viewing the information provided on the Website;

      2. Purchasing movie tickets, snack items, or other products offered through the Website for your personal use; or

      3. Joining promotions featured on the Website (if any).

    2. Any other use of the Website, Services, or their content not expressly allowed under these Terms and Conditions is strictly prohibited and may result in legal action under applicable Philippine laws. 

  1. COPYRIGHTS AND PROPRIETARY RIGHTS 

    1. All copyrights and other intellectual property rights on the Website, the Services, and all related content and materials (“Website Content”) are owned by ALMI, its parent company, subsidiaries, affiliates, suppliers, or licensors, unless otherwise expressly indicated. The Website Content is protected under Philippine and international copyright and trademark laws.

    2. You agree not to do any of the following without ALMI’s prior written consent:

      1. Use any Ayala All Access trademarks, except when printing or referencing an Ayala All Access product or service;

      2. Reproduce, copy, modify, merge, adapt, translate, re-publish, frame, upload to a third-party, post, transmit, broadcast, communicate to the public or otherwise make the Website Content available to the public;

      3. Transmit or display the Website Content on any system or network that allows simultaneous access by multiple users;

      4. Use, sell, assign, rent, sub-license, or otherwise deal with the Website Content except as permitted by the Terms and Conditions; or

      5. Engage in any activity that infringes on the intellectual property rights of ALMI, its affiliates, suppliers, or licensors.

    3. You may view this Website through a standard web browser, provided that you do not alter or remove any copyright or proprietary notices. If you are interested in a piece of Website Content solely for your own personal and non-commercial use, you may save, print, or download a single copy of that content. 

  1. PURCHASE POLICY AND REFUNDS 

    1. Movie tickets purchased through the Website will be charged a non-refundable convenience fee (in Philippine Pesos) per ticket.

    2. By purchasing movie tickets, snack items, or other goods through the Services, you represent and warrant that:

      1. The payment information you provide to our payment gateway provider is true, accurate, and complete; 

      2. All charges incurred by you will be honored by the relevant accredited payment provider; and 

      3. You agree to pay all charges at the posted prices including applicable taxes and fees.

    3. A transaction is deemed successful once you see a confirmation page on Ayala All Access and receive a booking confirmation email containing your transaction details at the email address you provided. If you do not receive an email confirmation within 10 minutes after completing your purchase, please contact Ayala All Access Customer Service at ayalaallaccess.support@ayalamalls.com for assistance.

    4. All payments are subject to the terms and conditions of the respective payment gateway provider, bank, credit card company, or e-wallet provider. Ayala All Access has no authority over payment processing and control of your bank, card, or e-wallet account details, which remain securely managed by your chosen provider.

    5. Using your booking confirmation email, you may claim your physical movie tickets at the ticket booth.   Unclaimed movie tickets after the screening period are considered expired and non-refundable.

    6. All movie admissions are subject to the Movie and Television Review and Classification Board (MTRCB) ratings and restrictions. Ayala Malls Cinemas reserves the right to refuse admission or refunds to persons who do not meet the age or guidance requirements for PG, SPG, R-13, R-16, or R-18 classified films (or any other classifications as may be imposed by MTRCB). Proof of age may be required.

    7. Movie tickets purchased through the Services are non-refundable. However, an Emergency Pass may be issued under specific circumstances outlined below. The Emergency Pass is governed by its own terms and conditions, as indicated at the back of the voucher.

      1. Technical or operational issues that prevent you from watching the movie as scheduled, such as:

        1. Cancellation or rescheduling of the movie; or

        2. Temporary closure or suspension of cinema operations at the scheduled date and time.

      2. Personal emergencies that prevent you from attending your scheduled screening, including illness, injury, accident, or other unforeseen events, provided that valid supporting documents (e.g., medical certificate, police report, or court summons) are submitted.

    8. Request for refunds due to non-admission because of the following reasons will not be honored:

      1. Non-eligibility to MTRCB rating;

      2. Incorrect selection of mall or cinema; and
      3. Non-compliance to the 4DX screening guidelines, as set out below:

        1. Must be at least 3.5 feet in height to be admitted to a 4DX cinema.
        2. Pregnant guests are not permitted to watch 4DX screenings.
        3. Canned beverages and hot drinks are not allowed inside the 4DX cinema. Only drinks with secure lids or covers are permitted.
        4. Ice cream is not allowed inside the 4DX cinema.

    9. Movie tickets purchased through third-party services aside from Ayala All Access are not refundable through this Website. Customers must coordinate directly with the third-party provider, subject to its own refund terms and conditions.  
  1. CHANGE OR MODIFICATION

    1. We reserve the right to modify, suspend, or discontinue (whether temporarily or permanently) this Website or any part of it, at any time and without prior notice. You agree that Ayala All Access and/or ALMI shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Website or its Services.

    2. Ayala All Access does not guarantee continuous, uninterrupted, or secure access to the Website or Services, as its operation may be affected by factors beyond our control. The Website may also be temporarily unavailable from time to time due to updates, system maintenance, or technical improvements.

    3. We will not be liable for any inconvenience, loss, or damage that may result from such interruptions or changes. 

  1. THIRD PARTY LINKS AND ADVERTISING

    1. Ayala All Access may provide links to third-party websites (“Linked Sites”) for your convenience. The inclusion of any link does not mean that Ayala All Access or ALMI, including its parent company, subsidiaries, or affiliates, endorses or is associated with these Linked Sites.

    2. Similarly, the appearance of third-party advertisements on the Website (whether with or without links) does not imply any recommendation, approval, or partnership with the advertiser.

    3. You acknowledge and agree that Linked Sites are not under the control of Ayala All Access / ALMI, and we are not responsible or liable for:

      1. The actions, omissions, or negligence of the owners or administrators of any Linked Site;

      2. The accuracy, legality, or appropriateness of their content;

      3. Any products, services, information offered on or through those sites; or

      4. Any damages or issues that may arise from your use of or reliance on those sites. 

  1. REMEDIES 

    1. Without limiting other available remedies, Ayala All Access may, at its sole discretion, restrict your activity, suspend, or permanently deny access to its Services if:

      1. You breach any of these Terms and Conditions or related policies;

      2. We are unable to verify or authenticate any information you provide that we deem necessary to process your transaction;

      3. We believe your actions may cause financial loss or legal liability to Ayala All Access or others; or

      4. We determine that your conduct is, or may be, harmful to our business interests.

    2. These actions are without prejudice to any measures that may be taken by our accredited payment gateway providers, including but not limited to blocking or blacklisting credit or debit cards suspected of fraudulent activity. 

  1. FORCE MAJURE 

    1. Ayala All Access / ALMI shall not be held liable for any delay, interruption, or failure to fulfill its obligations under these Terms and Conditions if such is caused by circumstances beyond its reasonable control. These include, but are not limited to, natural disasters, acts of God, war, terrorism, civil unrest, government actions, labor disputes, epidemics or pandemics, public health emergencies, power or internet outages, mechanical or system failures, or the unavailability of materials, equipment, or transportation – whether or not such events could have been anticipated. 

  1. GOVERNING LAW 

    1. These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of the Philippines.
